End User License Agreement

FreeSFX.co.uk through its web site offers a sound effects, production element and music search, licensing, and distribution platform (the "Platform") for selected audio material owned by The Brian Nimens Corporation Limited. Under applicable law, The Brian Nimens Corporation operating as FreeSFX.co.uk is the "data controller" of data collected through the Platform. The following discloses our information gathering and dissemination practices for the Platform.

Information We Collect
When you use the Platform, we may automatically gather your IP address. The following information is gathered when you enter it: email address, individual name. If you do not wish to provide this information, you will not be able to create an account, log in, or download audio files. We do not verify any of the data provided by users.

Where Information Is Processed
The Company is based in Canada. No matter where you are located, you consent to the processing and transferring of your information in and to Canada. The laws of Canada governing data collection and use may not be as comprehensive or protective as the laws of the country where you live.

How We Use Your Personal Information
By using the Platform and providing us with your Name and Email Address, you are granting us your consent to use your Information in the following ways:
Handling user requests, such as reaching out if we identify a problem you're having with the Platform. If you encounter a problem using the Platform and you reach out to us for assistance, we may use the contact information you previously entered to find more information about the issue and help address it. If the Platform generates an error while you're using it, we may log your name, email, or IP address to help us diagnose and fix the problem. In some rare cases, we may reach out to you once the error has been resolved. No one outside of the Company’s employees and technical professionals contracted by the Company for this express purpose has access to these logs. We may also reach out preemptively to notify you of important events, sales or product releases. Your personal information may be shared with other businesses owned by The Brian Nimens Corporation Limited for promotional purposes. Each of those businesses complies with GDPR in the handling of your personal data. We will never sell or share your contact information with third parties for marketing or any other purposes not explicitly outlined in this Policy.

Google Analytics
The Platform uses Google Analytics to track anonymized statistics about users and technology, which helps us improve the Platform. For example, we might look at trends in how many users use specific web browsers to help us determine which ones to support. We do not use this information to follow individuals but instead look for broader trends. Meeting Legal Requirements
The Company reserves the right to disclose any content, records, or electronic communication of any kind (including personal information or private electronic communication transmitted on the Platform): (i) to satisfy any law, regulation, or government request; (ii) if such disclosure is necessary or appropriate to operate Company; or (iii) to protect the rights or property of Company or its users, sponsors, providers, licensors, or merchants. Company also reserves the right to reject any transaction or request for download from any user.

Data Retention
We generally retain personal data for so long as it may be relevant to the purposes identified herein. To dispose of personal data, we may anonymize it, delete it or take other appropriate steps. Data may persist in copies made for backup and business continuity purposes for additional time.

Security
We take reasonable steps to protect the information provided to the Platform from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. However, no Internet or email transmission is ever fully secure or error free. In particular, email sent to or from the Platform may not be secure. Therefore, you should take special care in deciding what information you send to us via email. Please keep this in mind when disclosing any information via the Internet.

Your Data Rights and Choices
You may, at any time, request your account be deleted from the Platform. Requests can be sent by email to our contact email address and will be processed within 2 business days. Deleting your information will effectively close your online account and render it inactive. You will have no access to your account. Please note that such records as the Company would be required by law to maintain will be maintained.

Changes to this Policy
We reserve the right to update or modify this Policy at any time and from time to time without prior notice. Please review this policy periodically.
 



Free Sound Effects End user license agreement

Credit Required

You MUST credit freesfx.co.uk if you use our sound effects or music in your project. How you do this is up to you but please make sure that you include our website URL in your credit as follows: http://www.freesfx.co.uk

If your project doesn't have a website or blog associated with it the credit back can be printed on any artwork for your project, added to the final credits for a film, added to your YouTube video description etc. If none of the above apply to you - you can always Tweet about us and let everyone know that you used our sounds. What You CAN Use Our Sound Effects and Music For

You can use our sound effects and music in any commercial, non-commercial project including those that will be broadcast, including:

  • Films, television programmes and radio programmes.
  • YouTube videos. Because we now own the copyright (effective April 2016) for all of the content on our site we can now release any copyright flags that appear on your Youtube videos. If one of your videos is flagged, contact us by email and provide your Youtube Channel, or your account, and a link to the video in question. We will contact our internet watchdogs to have the infringement alert removed. You can still use the music with the infringement alert, but ads will be placed on your video - if that doesn't matter to you, it is okay with us because we get the revenue from the ad placements.
  • Websites, blogs and podcasts.
  • Games and apps (including iPhone, Android apps etc).
  • Exhibitions, conferences, museums etc.
  • In your school or college project.

You must credit freesfx.co.uk (as explained above) if you use any of our sound effects or music tracks in your projects. You can use our sound effects and music tracks subject to the following restrictions:


What You CAN NOT Use Our Sound Effects and Music For

  • A product/project where the sound effects are the main focus. For example, a 'guess the sound' app. Sound effects can only be mixed in and be used to enhance the overall project.
  • You can not use our sound effects in isolation. They must be mixed into other audio/visual elements in your project. 
  • Our music tracks can not be released as commercial music releases. They are for the purpose of synchronizing to audio/visual projects.
  • You can not give the sound effects or music tracks to any other person. They must not be added to any file sharing networks, give-away promotions, free give-aways or shared in any manner. You can not sell, rent, loan, lease, sub-license or make the sound effects or music tracks available to any other person. 
  • You can not claim ownership of any of the sound effects or music tracks from freesfx.co.uk and all sound effects and music tracks remain copyright of the original owner at all times.

The Full Licence

IMPORTANT - PLEASE READ CAREFULLY

By licensing, copying, downloading or otherwise using sound effects and/or music (hereinafter referred to as "Sounds") from Freesfx.co.uk, you (hereinafter referred to as "the Licensee") agree to be bound by the terms of this End User License Agreement (hereinafter referred to as the "EULA"). If you do not fully agree to the terms of this EULA, you may not use, copy, keep or store the Sounds.

Freesfx.co.uk reserves all rights not expressly granted to the Licensee.

Grant of License
All sounds available from Freesfx.co.uk are licensed, not sold by Freesfx.co.uk, to you, the Licensee. Freesfx.co.uk remains at all times the owner of the Sounds.

Permitted Uses
Freesfx.co.uk grants to the Licensee through this EULA the following limited, non-exclusive world wide rights:

The Licensee may use the Sounds in any audio/ visual production (hereinafter referred to as "Production"), such as a film, television or video programme, animation, advertisement, Website, CD or DVD-ROM, commercial sound recording, audio download, video game, software product, personal ringtone, or other media or multimedia production, without paying any royalties, license fees, or any other fees to Freesfx.co.uk or any third parties, subject to the following restrictions:

Restrictions on Use

  • The Licensee may not lend, share, distribute, sell, rent, lease, sublicense, assign, or otherwise transfer any of the Sounds except where Sounds have been incorporated by the Licensee in a Production.
  • The Licensee may not distribute the Sounds independently of a Production, in that Sounds may be synchronised with images as an integral part of a Production, or used as part of an audio production, but are not to be distributed as "standalone" Sounds.
  • The Licensee may not cause or allow the Sounds to be electronically transmitted or available to file sharing networks.
  • The Licensee may not alter or delete any "watermark" or inaudible identifier embedded within the Sounds.

Indemnification
The Licensee will indemnify, save, hold harmless and defend Freesfx.co.uk from, and against any and all claims, demands, suits, damages, liabilities and all reasonable expenses, including legal fees incurred by Freesfx.co.uk with respect to any matter that arises as a result of a breach of this Agreement by the Licensee. 

Disclaimer of Warranties
Freesfx.co.uk supplies Sounds on an "as is" basis, and expressly disclaims all warranties of conditions of any kind, whether express or implied, including without limitation, any implied warranty of title, non-infringement, merchantability or fitness for a particular purpose with respect to its Website, or to any services supplied to its Licensees.

Limitation of Liability
The Licensee agrees that Freesfx.co.uk holds no liability with respect to any claims made in relation to or arising out of this agreement.

Jurisdiction
This Agreement shall be governed by and construed in accordance with the Laws of the Province of Ontario, Canada and the courts of Ontario shall have sole jurisdiction.

Entire Agreement
This License Agreement constitutes the entire agreement between Freesfx.co.uk and the Licensee with respect to the Sounds. Any modification or waiver of any of the provisions of this agreement must be in writing and signed by both parties, or conducted by both sides via the Freesfx.co.uk Website.

This web site provides free sound effects that you are able to use in any commercial, non-commercial, broadcast multimedia/audio visual production.

What do we get in return?

You must credit freesfx.co.uk if you use our sound effects or music in your project. How you do this is up to you but please make sure that you include our website URL in your credit.

What do we offer?

More than 4,500 individual sound effects files, all fully catalogued so you can search or browse through our sound effect categories to find what you need. And we aren't just sitting back to let it ride. We are still curating and adding new sounds to the site every month.

More than 850 music tracks in a variety of styles from Comedy to Patriotic.

You can use these free sounds in films, television programs and commercials, radio programs and commercials, public service announcements.

You can make money by using these sounds in games or apps; on web sites, in blogs or podcasts. Check out our End User License (link below) for full details.

There are some restrictions in how you can use our sound effects and music, but they all make sense. You can't claim them as your own or distribute to other folks. You can't use the sounds in isolation; they must be mixed into other audio or visual elements in your project. But you can use them for a live theatrical performance, for instance if there is creaking door or a thunder roll that occurs offstage. That would be a perfect live performance use for our sounds. What Are Sound Effects?

We think of sound effects as falling into 4 main categories: isolated sounds, specialty effects, foley sounds and background sounds.

Isolated Sounds
Isolated sounds include the sounds of everyday items like doorbells, car horns and telephone rings. These are the real and specific sounds that you hear such as dogs barking, guns firing, doors slamming and car tires screeching during a car chase.

Specialty Effects
Specialty effects include sounds that are designed to be used for objects and places that exist only in our imaginations. You might use special effects in cartoon, fantasy and science fiction productions. They would enhance the production by creating a special sound for a space transporter, the magic of a genie's brass lamp, or for gigantic purple people eater cartoon animals.

Foley Sounds
Foley sounds are crucial for motion picture and television productions; sometimes the use of Foley sounds is called audio sound replacement. The magic of Foley places footsteps into a film soundtrack – recreates the rattle of a coffee cup being put down on a table – provides the realistic rustle of clothing and the ever popular punch in the face. These and many other sounds must be dubbed during post production on the film's soundtrack in order to be heard by the audience. They are named after Jack Foley – a pioneer in the sound replacement field.

Background Sounds
Background sounds, or ambience tracks, provide the basic environment for a production. These sounds provide all of the subtle atmosphere that makes the film-goer or binge-watcher really feel like he is in a courtroom, a church, a train station, a thunderstorm or a jungle.
